Just a little doubt

The point cost of the phoenix includes the annointed on top?

It cost the same points with or without the hero?

The subject was already discussed many times and the most common advice is that it does. Until there will be separate points for rider and riderless phoenix they cost both the same. It is the same for a lot of "optional heroes" like the cauldron, the luminark, etc.

The best way is to discuss with your opponent before fielding such units to be sure you agreed on the point costs.

In a tournaments, the organiser will surely have a word about such units.

Same warscroll, same points cost. The hero rider is an option with reason not to add unless you don't want to pay a leader slot.

The only downside i can think about is the Speatheart bataillon that require you to have exactly one annointed so you must have 1-3 riderless phoenix.
