Heralds can always be allied into any destruction army regardless of their ally lists and do not count towards determining your army's allegiance. They can also be your general irrespective of allegiance. They do count against your ally point allotment, but the current FAQ (probably because it hasn't been updated and they forgot that it might matter) only has them follow some of the ally rules and doesn't go so far as to call them actual allies, nor count against the 1-per-4 rule. If you intend on playing one I'd say you're as safe as can be, if you want 4 (or like 2 normal allies and one fungoid with <12 units) then caution to wait for the 2-wk faq.
