Wait a minute, the only guy that has Aqshy's Bane is Khorgos Khul and he is a named character and as such cannot receive artifacts nor command traits as per General's Handbook (unless there has been a faq or BoK has special rules that bypass the named character clause of the GHB) so that may invalidate all of this.

 Aqshys Bane is both a Hero Ability, and a Warscroll Battalion Ability ... 

Several FAQ items:

Page 79 – Battle Traits, Blood for the Blood God! Change the first sentence of the last paragraph to: ‘Unless stated otherwise in the rule for a reward, Blood Tithe points can be expended at the start of either player’s hero phase, but only once per phase.’

 

Q: When can I expend Blood Tithe points in order to use a reward in the hero phase?

A: Blood Tithe points must be expended before your opponent uses any start-of-turn abilities in your own hero phase, or after your opponent has used any start-of- turn abilities in your opponent’s hero phase.

 

So blood tithe 5 would have to be "paid for and used" prior to using Aqshy's Bane. And that ability was FAQ'd as well...

Change the rules text to:

‘Select a Khorne unit from your army that is within 3" of an enemy model; that unit can immediately pile in and attack as if it were the combat phase.’

 

Aqshy's Bane is also an ability from the Goretide Battalion. But it did get FAQ'd

Change the rules text to:

‘In each of your hero phases, if the Goretide’s Mighty Lord of Khorne is within 8" of any enemy models he can pile in up to 8" and attack. If he does so, you can re-roll all failed hit rolls for the Goretide’s Mighty Lord of Khorne, including any attacks made with the Blood-dark Claws of his ferocious Flesh Hound.’

 

There is legitimate reference in the Khul Warscroll to having to take Khul. (Though that is debatable ... and has been debated.) So, If you take the Goretide Warscroll Battalion then per Khorgos Khul's Warscroll you have to take Khul.

"...Korghos Khul leads the Goretide, and always wears their colours in battle. If you take a Goretide warscroll battalion, then Korghos Khul must be taken instead of the Mighty Lord of Khorne that normally leads the battalion...."

 

The Mark of the Destroyer doesn't affect the fleshhound. It only affects The MLoK and his melee weapon. It doesn't do anything for claws and fangs that aren't his.

 

In any regards the blood tithe version in hero phase attacks are "...attack as if it were the combat phase" so it could be argued that the Combat phase rules apply. So he doesn't kill someone ... poof he's a Spawn?
