If I set up a unit of flayers with  the summon the royal guard ability and they die can I use the ability to set up the same unit again?

You can you the ability till you have the points to summon. Otherways...nope

its technically not the same unit you setup, it's another unit. In matched play this counts towards your summoning points (if you have any). if you field a 2000 point army in a 2000 point game, you cannot use any of death's abilities that add units to the battle

As above. In matched play summoning models onto the field count towards your max roster points (i.e. In a 2000pt roster if you have 2000pts deployed at game start you cannot use the command ability for the entire game) in open play use it every turn (depending on agreed pregame ideas with opponent)

Sorry my first message was not clear.  Lets say that I have the 160 points left for summon the unit with the ability.  The unit is dead can I summon back that unit?

you cannot resummon unless you have the spare points.

I think this is what you might be getting at: if you have a unit of models on the board that are killed and removed, can the same unit of models be used to represent a new unit (providing you have the summoning points)? Or do you need seperate models? - is that more or less the question?

If so, I don't see why anyone would take issue with it.

you can use the very same models but they count as a new unit and you need the points resummoning them. even if you play it as "resurrecting slain units", every unit that leaves the fields and comes back later counts as a new unit (same with ring of immortality artefact).
